This Privacy Policy (“Privacy Policy”) is incorporated into our Terms of Service. Therefore, terms used in this Privacy Policy that have been defined in our Terms of Service will have the same meaning as provided therein. As with our Terms of Service, if we make any changes to our Privacy Policy, we will post the revised Privacy Policy and update the “Last Revised” date of the Privacy Policy. Information Collection and Use

Vibe requires users to register for the service and provide personal information, ( such as user’s mobile number, name, email, contact address, Vibe charging information, computer/mobile browser information, IP address, device and location information, song listening information and pattern etc). Vibe uses this information to establish and deliver service to the users. Vibe may use this information to contact registered users to notify them of product and service updates, provide instruction, and to deliver other service related information. Vibe may also contact users to request additional information (location & device details) and feedback. Vibe may employ companies and people (“Agents”) to perform tasks on its behalf, and will need to share personal information with these Agents to establish and deliver service to the users. Vibe's Agents do not receive any right to use personal information beyond what is necessary to perform these tasks.

If you connect to Vibe using facebook, the default setting is generally that Vibe automatically shares your activity and activity-related stories with that service, including the music you listen to. You understand that such information may be attributed to your account on facebook or the other integrated service and may be published on such service. Vibe may store your username and access token or similar credentials obtained from the third party service, so that you are able to share particular items of content, on that third party service, on an individual basis, without entering your access credentials again.

You understand and agree that facebook or other third parties’ use of information they collect from you is governed by their privacy policies, and Vibe’s use of such information is governed by this Privacy Policy.

We may from time to time share your information with other companies in the Vibe group as well as certain trusted business partners and third party service providers to enable them to perform functions and process user data on our behalf. Such third parties' processing of user data is subject to security and confidentiality obligations consistent with this Privacy Policy and applicable law.

In addition to the above, we may also share your information to third parties for these limited purposes:

  1. To allow a merger, acquisition, or sale of all or a portion of our assets;
  2. To respond to legal process (e.g. a court order or subpoena), if we believe in good faith that it is necessary to do so upon conducting comprehensive due diligence; to comply with requirements of mandatory applicable law; to protect the safety of any person; to protect the rights and property of Vibe, including to enforce the Terms and Conditions of Use; and to address fraud, security or technical issues;
  3. To allow other companies affiliated with Vibe to use your information as specified in this Privacy Policy;
  4. To inform business partners about use of the Service and products and services made available through the Service, in the form of aggregated statistics or otherwise in a format which does not reveal your identity; and
  5. If you expressly opt in to such sharing.

You understand and agree that the privacy policies of third parties will govern all use of information that we provide to them under this section.

Vibe may automatically collect and analyze information regarding the use of Vibe's services and Vibe site activity. Information collected may include but is not limited to web site traffic volume, frequency of visits, type and time of transactions, type of browser and operating system, etc. This information is logged to help diagnose technical problems, administer the site, and improve the quality and types of service delivered. Vibe may also collect, track, and analyze information that does not personally identify a user in aggregate form. This aggregate data will be used at Vibe's discretion and may be shared with third parties, but with no personally identifiable information attached. Registered users will be using the site to host relationship data. Relationship data sent to Vibe servers by the user will remain the property of the user. Vibe will not review, share, distribute, or reference such data, except as may be required to provide the requested Vibe services, or as provided in the Vibe Terms of Use Agreement, or as may be required by law.

If a user elects to use Vibe's invite service to tell others about Vibe, Vibe will generate and send an SMS to each MSISDN address added by the user. These MSISDN addresses will be used for the sole purpose of inviting individuals to use the service, and will not be treated as registered users' MSISDN addresses.

If a user's personally identifiable information changes, or if a user no longer desires to use Vibe's services, users can correct or update their personally identifiable information, or deactivate their accounts on the service through Apps or SMS. Cookies & Beacons

Vibe uses cookies and beacons to assist in delivering the service and to provide a positive and personalized user experience. Cookies are files sent to your browser from a web server and stored on your computer's hard drive. Our persistent and session ID Cookies are used to identify unique visitors and to provide a personalized user experience. Beacons are bits of code that function similar to cookies. Our beacons are embedded in outgoing emails and generate a call back to the Vibe server when such emails are opened. Vibe uses beacons to track the status of sent emails.

Security

Vibe has implemented processes designed to protect user information and maintain security. Each registered user is assigned a unique user MSISDN and password, which is required to access the user's account and relationship information. It is the user's responsibility to protect the security of their login information. Vibe's servers are located in secure server environments. Firewalls and other advanced security technologies are employed to prevent interference or access from outside intruders. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of data.

Third Party Sites

Vibe's sites may contain links to third party web sites not associated with Vibe. Vibe is not responsible for the privacy practices or content of such sites. Users will need to review the policy statements of these sites to understand their privacy policies.

Privacy Policy Changes

Vibe reserves the right to make changes to this privacy statement. Any material changes to this statement will be prominently posted online and accessible via the Vibe user portal 30 days prior to taking effect.

Jurisdictional Issues

We intend to provide our services in Bangladesh; accordingly, this Privacy Policy and our collection, use, and disclosure of your Information, is governed by the laws of Bangladesh. We do not represent or warrant that our services are appropriate or available for use in any other jurisdiction. If you choose to access or use our services from outside Bangladesh, you do so on your own initiative and solely at your own risk. You acknowledge that our services are subject to the laws of Bangladesh and consent to the transfer of your Information to Bangladesh, which may provide a different level of data security than in the country in which you are located and you waive any claims that may arise under the laws of your location outside Bangladesh.

We will take all reasonable steps necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

Acknowledgement of Acceptance

The Parties acknowledge and accept that electronic format shall be deemed an acceptable means of communication for the purposes of this Private Policy.

By subscribing to accessing or using VIBE, you acknowledge that you understand its views and practices regarding your personal data and how your personal data will be treated and accept the practices and policies outlined in this Privacy Policy. You further consent to VIBE’s collecting, using and disclosing your information as described in this Privacy Policy. If you are using VIBE on behalf of an individual or legal entity other than yourself, you represent that you are authorized by such individual or legal entity to accept this Privacy Policy on such individual’s or legal entity’s behalf.

By subscribing to the services of VIBE, the user agrees to the terms and conditions contained in this Privacy Policy and consents to the disclosure of user information in the manner contained herein to third parties.
